Abstract

The State Military Justice court follow a different routine from other criminal courts, observing their own codes which, although similar to common Criminal Law, follow strict rules that reflect the specificity of military life within the units, especially regarding the observance of the principles of hierarchy and discipline, which are also reflected in judicial decisions.The objective of this work is to present data and arguments that allows the use of legal instruments with lesser penal impact and prove their effectiveness in terms of reducing new cases, providing real data from the years 2022, 2023 and 2024 (up to the month of May), concerning of non-prosecution agreements in military cases. To this end, qualitative and quantitative research methods will be used, including bibliographic, jurisprudential, and exploratory research of official data. During this study, the legal implications of applying this institute in the State Military Justice system will be observed.
